1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and MoneyAlert governing your use of MoneyAlert (moneyalert.app). By creating an account or accessing the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. We may update these Terms by posting a revised version; the "Last updated" date at the top indicates the most recent revision. Your continued use after any update constitutes acceptance.

2. Service Description

MoneyAlert provides real-time price monitoring and alert notifications for cryptocurrencies, stocks, and commodities across multiple exchanges. Alerts can be delivered via Telegram, SMS, phone call, and WhatsApp. The Service also offers Telegram channel monitoring for keyword-based alerts. The Service is provided for informational purposes only and does not constitute financial advice.

3. User Representations & Accounts

By using the Service, you represent and warrant that: (a) all registration information you submit is truthful, accurate, and current; (b) you have the legal capacity to agree to these Terms; (c) you are at least 18 years of age; (d) you will not access the Service through automated or non-human means (bots, scrapers, etc.); (e) you will not use the Service for any illegal or unauthorized purpose; and (f) your use will not violate any applicable law or regulation. You are responsible for maintaining the confidentiality of your account credentials. One person may not maintain more than one account. We reserve the right to suspend or terminate accounts with inaccurate information.

4. Prohibited Activities

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to the Service, other accounts, or computer systems; (c) interfere with or disrupt the Service or servers; (d) use automated tools to scrape, mine, or extract data beyond normal usage; (e) reverse engineer, decompile, or disassemble any part of the Service; (f) resell, redistribute, or commercially exploit the Service without authorization; (g) upload or transmit viruses, malware, or other harmful code; (h) harass, abuse, or harm other users; (i) use the Service to send spam or unsolicited communications; (j) attempt to bypass any security features or rate limits; (k) impersonate another person or entity; or (l) use the Service to compete with MoneyAlert.

5. Subscription & Payments

MoneyAlert offers free and paid subscription plans. Paid plans are billed monthly or annually through our payment provider (Paddle). Prices are subject to change with reasonable notice. You may cancel your subscription at any time; access continues until the end of the current billing period. Subscriptions auto-renew unless canceled before the renewal date. All sales are final unless otherwise required by applicable law. We reserve the right to refuse, limit, or cancel orders at our discretion.

6. Intellectual Property

All content, features, functionality, source code, designs, logos, and trademarks of the Service are owned by MoneyAlert and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without prior written consent. All rights not expressly granted are reserved by MoneyAlert.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MoneyAlert does not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) price data will be accurate, complete, or timely; (c) notifications will be delivered without delay or failure; or (d) the results obtained from the Service will meet your requirements. MoneyAlert is NOT a financial advisor. Price data is sourced from third-party exchanges and may be delayed, inaccurate, or incomplete. You are solely responsible for your investment and trading decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONEYALERT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR INVESTMENT OPPORTUNITIES, ARISING FROM: (a) your use of or inability to use the Service; (b) any unauthorized access to your account or data; (c) any interruption or cessation of the Service; (d) any errors, inaccuracies, or delays in price data or notifications; or (e) any third-party conduct on the Service. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless MoneyAlert and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any investment or trading decisions you make based on information obtained through the Service.

10. Termination

We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through the Settings page. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall continue to apply.

11. Dispute Resolution

In the event of a dispute, you agree to first attempt to resolve it informally by contacting us at support@moneyalert.app. If the dispute is not resolved within thirty (30) days, either party may pursue formal resolution. You agree that any legal action or proceeding shall be brought exclusively in the courts of Seoul, Republic of Korea. YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION against MoneyAlert.

12. Electronic Communications

By using the Service, you consent to receive electronic communications from us, including emails, push notifications, and in-app messages. You agree that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.

14. Miscellaneous

These Terms constitute the entire agreement between you and MoneyAlert regarding the Service. If any provision is found to be unenforceable, the remaining provisions shall continue in full force and effect (severability). Our failure to enforce any right or provision shall not constitute a waiver. You may not assign or transfer these Terms without our consent. Nothing in these Terms creates a partnership, joint venture, or agency relationship.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of law principles.
